These Terms of Service (“Terms”) govern your access to and use of Property Compared (the “Service”), provided by Property Compared (“we”, “us”, or “our”). By creating an account or using the Service, you agree to be bound by these Terms.

1. The Service

Property Compared is an online tool that lets you compare properties using visual analytics, scoring, and summaries, and save comparisons and addresses to your account.

2. No warranty on data accuracy

The Service is provided “as is” and “as available”. Property data, scores, estimates, and summaries may be incomplete, out of date, estimated, or synthetic, and may not reflect actual market conditions or the true characteristics of any property. To the extent permitted by law, we make no warranties or representations about the accuracy, completeness, reliability, or fitness for any purpose of any information provided through the Service. Nothing in these Terms excludes any rights or guarantees you have under the Australian Consumer Law that cannot lawfully be excluded.

3. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in breach of these Terms;
• attempt to gain unauthorised access to the Service, other accounts, or our systems;
• scrape, harvest, or systematically extract data from the Service except as expressly permitted;
• interfere with, disrupt, or place undue load on the Service or its infrastructure; or
• resell or commercially exploit the Service without our written consent.

4. Accounts and termination

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You may delete your account at any time from your account settings. We may suspend or terminate your access if you breach these Terms or where reasonably necessary to protect the Service or other users.

5. Limitation of liability

To the maximum extent permitted by law, Property Compared and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive loss, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Service or reliance on any information it provides. Where our liability cannot be excluded but can be limited, our liability is limited to re-supplying the Service or the cost of re-supplying it.

6. Governing law

These Terms are governed by the laws of the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from them.

7. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
